Terms and Conditions of Sale of Images
Supply of images
All images supplied
are for use only as agreed at the time of supply, and are supplied for that single use
only, and should not be used for any other purposes other than by prior arrangement.
All acknowledgements and credits shall be printed along
with the photographs at the time of publication, and one copy of the print, or
publication, shall be sent to the photographer at the address below.
Receipt of a copy of the print or publication is part of
the contractual requirements that you agree to by using any images supplied to you by
David Heath Photography.

All site content is the property of David Heath under the
Copyright, Designs and Patents Act 1988.
Copyright of all photographic images on the site remains
the property of David Heath.
All images supplied are subject to copyright and any
unauthorised use of any image in any way is a breach of that copyright and as such is
illegal. Any unauthorised use of an image will be considered a breach of copyright and an
invoice for financial recompense of at least 4 times the usual fee will be issued.
All prints supplied by mail order are subject to copyright
and should not be reproduced in any form whatsoever.
All prints will have a copyright label affixed to rear of
the print, and this should not be removed.
Supply of prints by mail order
The colour rendition of supplied prints may not exactly
match that of the images when viewed on the David Heath Photography web site.
Delivery of prints shall be deemed to have taken place
immediately they leave our premises, and any risk shall pass to the purchaser at the time
of posting, therefore you should arrange for any required insurance cover for the items
whilst in transit, as we will not accept responsibility for any loss or damage to items
once they have been despatched.
We will take all reasonable steps to meet any quoted
delivery dates but will not be liable for any delay, failure or error in delivery of
items. All print orders shall be appropriately packaged and clearly addressed with the
delivery address supplied at the time of purchase.
Prices and Payment
All invoices are required, as indicated on the invoice, to
be paid within 21 days of the invoice date.
All payments shall be made in £ sterling for the full
invoice amount.
All cheques shall be made payable to "David
Heath", and should a cheque not be honoured an administration charge of £25 will be
made for any and each subsequent representation of the cheque.
Any account where an outstanding balance is overdue by
more than 60 days will be referred to a debt collection agency, and will result in an
administration charge being added to the original invoice value, this procedure may also
lead to court action and may affect your credit rating.
